सुप्रीम कोर्ट ने बिहार में पुलिस मुठभेड़ों की सीबीआई जांच और एक विशेषज्ञ समिति के गठन की मांग वाली याचिका पर सुनवाई से इनकार कर दिया है। जस्टिस बेला एम. त्रिवेदी और जस्टिस पंकज मित्तल की अवकाश पीठ ने याचिकाकर्ता से कहा कि वह उच्च न्यायालय का दरवाजा खटखटाए। अदालत ने याचिकाकर्ता के वकील से पूछा कि क्या उन्होंने पहले पटना उच्च न्यायालय में याचिका दायर की थी, जिस पर वकील ने नकारात्मक जवाब दिया। इसके बाद कोर्ट ने साफ तौर पर कहा कि वे इस मामले में हस्तक्षेप नहीं करेंगे और याचिकाकर्ता को उचित फोरम यानी उच्च न्यायालय में जाने की सलाह दी।
यह याचिका एक सामाजिक कार्यकर्ता विशाल तिवारी ने दायर की थी, जिसमें बिहार में कथित फर्जी मुठभेड़ों की बढ़ती घटनाओं पर चिंता व्यक्त की गई थी। याचिका में आरोप लगाया गया था कि बिहार पुलिस द्वारा की गई मुठभेड़ें अक्सर संदिग्ध परिस्थितियों में होती हैं और इनमें मानवाधिकारों का उल्लंघन होता है। याचिकाकर्ता ने दावा किया था कि इन मुठभेड़ों की निष्पक्ष जांच आवश्यक है ताकि पीड़ितों को न्याय मिल सके और पुलिस जवाबदेही सुनिश्चित हो सके। उन्होंने सुप्रीम कोर्ट से आग्रह किया था कि वह इन मुठभेड़ों की गहन और स्वतंत्र जांच के लिए सीबीआई को निर्देश दे, साथ ही भविष्य में ऐसी घटनाओं को रोकने के लिए एक विशेषज्ञ समिति का गठन करे जो पुलिस बल के लिए दिशानिर्देश तैयार करे।
सुप्रीम कोर्ट के इस फैसले से याचिकाकर्ता को अब पटना उच्च न्यायालय में अपनी लड़ाई जारी रखनी होगी। हालांकि, यह निर्णय न्यायिक प्रक्रिया के एक महत्वपूर्ण पहलू को उजागर करता है कि पहले निचली अदालतों या उच्च न्यायालयों का दरवाजा खटखटाया जाना चाहिए, खासकर जब राज्य-विशिष्ट मुद्दों की बात हो। यह देखना दिलचस्प होगा कि पटना उच्च न्यायालय इस मामले पर क्या रुख अपनाता है और क्या वह बिहार में पुलिस मुठभेड़ों की जांच के लिए कोई निर्देश जारी करता है।
The Supreme Court has refused to hear a petition seeking a CBI investigation and the formation of an expert committee into alleged police encounters in Bihar. The vacation bench of Justices Bela M. Trivedi and Pankaj Mithal directed the petitioner to approach the High Court. The court inquired if the petitioner had previously filed a plea in the Patna High Court, to which the lawyer responded negatively. The petitioner had claimed that an impartial investigation into these encounters is necessary to ensure justice for the victims and police accountability. He urged the Supreme Court to direct the CBI for a thorough and independent investigation into these encounters and to form an expert committee to formulate guidelines for the police force to prevent such incidents in the future. With this decision, the petitioner will now have to continue his fight in the Patna High Court. This ruling underscores the judicial principle that lower courts or High Courts should be approached first, especially for state-specific issues. It remains to be seen what stance the Patna High Court will take on this matter.
