देवरिया जनपद के भाटपार रानी तहसील बार संघ के अध्यक्ष के खिलाफ अधिवक्ता भानुप्रताप सिंह और दीपक मिश्रा ने अविश्वास प्रस्ताव पेश किया है। यह प्रस्ताव सुधांशु वर्मा को सौंपा गया है, जिसमें अध्यक्ष पर मनमाने निर्णय लेने और संघ के नियमों का उल्लंघन करने के गंभीर आरोप लगाए गए हैं। प्रस्ताव में स्पष्ट रूप से कहा गया है कि वर्तमान अध्यक्ष मनमाने ढंग से निर्णय ले रहे हैं और संघ के उपनियमों का खुलेआम उल्लंघन कर रहे हैं।
अधिवक्ताओं ने आरोप लगाया है कि अध्यक्ष सत्यनिष्ठ व्यक्तियों के खिलाफ एकतरफा निर्णय लेते हैं और अधिवक्ता हितों के विपरीत गतिविधियों तथा आदेश देते हैं। संघ के उपनियमों के अनुसार, निर्वाचित होने के दो महीने बाद सभी अधिवक्ताओं/मतदाताओं/सदस्यों को सर्वसम्मति से अध्यक्ष के खिलाफ अविश्वास प्रस्ताव लाने का अधिकार है। प्रस्ताव में यह भी बताया गया है कि नवनिर्वाचित अध्यक्ष का कर्तव्य होता है कि वह अधिवक्ता हितों की रक्षा करे और बार-बेंच में सामंजस्य बनाए रखे, लेकिन वर्तमान अध्यक्ष अधिवक्ताओं के प्रति तानाशाही रवैया अपना रहे हैं।
अधिवक्ताओं ने यह भी शिकायत की है कि बेंच/अधिकारी/कर्मचारी द्वारा अधिवक्ताओं का अपमान किया जा रहा है और तहसील में भ्रष्टाचार चरम पर है। उनका दावा है कि वर्तमान अध्यक्ष के कार्यकाल में भ्रष्टाचार में वृद्धि हुई है। बार-बार संज्ञान में लाने के बावजूद अधिवक्ता हित और जनहित में कोई कार्रवाई नहीं हो रही है। प्रस्ताव में यह भी बताया गया है कि अध्यक्ष का दायित्व अधिवक्ताओं के हित को सर्वोपरि रखना है, लेकिन वर्तमान अध्यक्ष व्यक्तिगत हित और अपने स्वार्थ में काम कर रहे हैं। उन पर अपने कर्तव्यों का निर्वहन न करने का आरोप है।
अधिवक्ताओं ने सर्वसम्मति से वर्तमान अध्यक्ष के विरुद्ध अविश्वास प्रस्ताव लाना जनहित और अधिवक्ता हित में आवश्यक तथा न्यायसंगत बताया है। उन्होंने वर्तमान निर्वाचित अध्यक्ष की अध्यक्षता रद्द कर उपनियमों के अनुसार नए अध्यक्ष के गठन की कार्यवाही की मांग की है। इस प्रस्ताव के साथ रामप्रवेश उपाध्याय, धनंजय प्रताप, भगवान दास मौर्य, विनय कुमार सिंह, राना सिंह, राणा प्रताप सिंह, मृत्युंजय कुमार गोंड, अशोक कुमार यादव, सतीभ कुमार, शिवप्रकाश गुप्ता, सुधांशु भूषण वर्मा, महेश चंद्र श्रीवास्तव, प्रेमनारायण गुप्ता, प्रदीप गुप्ता, बृजेश कुमार, गौरव कुमार श्रीवास्तव, संदीप सिंह, लालबाबू प्रसाद, विजय कुमार, मुकेश कुमार श्रीवास्तव, महेंद्र प्रताप, संजय पांडे, वृज राज सहित कुल 46 अधिवक्ताओं के हस्ताक्षर भी संलग्न किए गए हैं।
A no-confidence motion has been brought against the president of the Bhatpar Rani Tehsil Bar Association in Deoria district by advocates Bhanupratap Singh and Deepak Mishra. The motion, submitted to Sudhanshu Verma, accuses the president of making arbitrary decisions and violating the association's rules.
The proposal states that the current president is making unilateral decisions and openly flouting the bylaws of the association. He is also accused of making one-sided decisions against honest individuals and engaging in activities and issuing orders contrary to the interests of advocates. According to the association's bylaws, members have the right to bring a no-confidence motion against the president by consensus two months after their election.
The advocates assert that the duty of a newly elected president is to protect the interests of advocates and maintain harmony between the bar and the bench. However, the current president is allegedly adopting a dictatorial attitude towards advocates. Furthermore, they claim that advocates are being insulted by the bench, officials, and staff, and corruption is rampant in the tehsil, having increased during the current president's tenure. Despite repeated complaints, no action has been taken in the interest of advocates or the public.
The motion highlights that the president's responsibility is to prioritize the interests of advocates, but the current president is acting out of personal interest and self-gain, failing to discharge his duties. The advocates have unanimously deemed the no-confidence motion necessary and just for public and advocate interests. They demand the cancellation of the current president's tenure and the formation of a new president in accordance with the bylaws. The proposal includes the signatures of 46 advocates, including Rampradesh Upadhyay, Dhananjay Pratap, and others.
